New York City Issues New Rule for Commercial Waste and Recycling Collection
Notice of Adoption: New York City Administrative Code 16-120
Enforcement begins 4/1/2023
The New York City Department of Sanitation has issued a notice of adoption for New York City Administrative Code 16-120. Section 16-120 governs the time and manner in which NYC commercial establishments and residents may place solid waste and recyclable materials out at the curb for collection.
The new ruling will not affect containerized or off-street collection, including collection that takes place in a loading dock.
What does this mean for NYC Customers?

16-120 states that bags of waste must be set out no earlier than 8:00pm for either residential or commercial properties
establishments that place materials out for collection in bags, regardless of the time they close, may place such materials at the curb no earlier than 8:00pm
Why has DSNY issued this ruling?
The new ruling is expected to improve the quality of life for New York City residents and operating businesses. 16-120 helps to clarify DSNY’s enforcement practices and reduces food sources for pests by governing collection times and/or requiring the use of receptacles.
