Please read these SMS/Text Messaging Terms & Conditions carefully. By completing the SMS/Text Messaging Opt-In Form, you expressly consent to receive non-marketing and marketing text messages from Interstate Waste Services, Inc. and its subsidiaries and affiliates (the “Company”) including text messages made with an Auto dialer, at the mobile phone number(s) you provide. Consent to receive text messages is not required to purchase any products or services from Company.
You may opt-out of these communications at any time by replying STOP to any text message from Company or by otherwise contacting the Company as indicated below. You can receive help at any time by replying HELP to any text message from the Company or by otherwise contacting Company as indicated below.
Messaging and data rates may apply by your mobile carrier. By opting to receive SMS Text Messaging, you also accept and agree to be bound by these SMS Text Messaging Terms & Conditions and any other applicable terms and agreements related to your use of Company’s services. Also, by subscribing, you consent to the Company contacting you even if your telephone number is listed on any federal, state, or private do-not-call registry.
Program Description
Company offers its text messaging program whereby Company will text message you to provide you with information concerning your account activity with Company and other Company products and services. Company and its service providers may, from time to time, use standard or an automatic telephone dialing system (“Auto dialer”) to deliver text messages to you. We reserve the right to terminate the text messaging program, in whole or in part, at any time without notice. The information in any message may be subject to certain time lags and/or delays.
Message Frequency
The number of text messages that you receive may vary depending upon your account activity and your communication with Company. In certain instances, you may receive multiple text messages to overcome character limitations to fulfill your request for text communication. [Should this happen, we will include “1/2” or “1/3” to reflect the order and number of texts.]
How to Opt-In
To opt-in to receive text messages from Company, fill out the opt in form on our website https://interstatewaste.com/text-alerts or text “ALERTS” to 25721. Please note that text messages will be sent to the number that you provide. Company will then send you a text message asking you to confirm your enrollment.
How to Opt-Out
To STOP receiving text messages from Company, text STOP to the ten-digit long code from which the text messages are being sent. You will then receive confirmation of your opt-out of the Company text messaging program by one (1) final message which you consent to receive.
You may also opt out by providing written notice to the Company at 300 Frank W Burr Boulevard, Suite 39, Teaneck, New Jersey 07666 or by emailing Company at customerservice@interstatewaste.com, or calling Company at 1-866-342-5497.
Your Mobile Telephone Number
You represent that you are the account holder for the mobile telephone number(s) that you provide or that you have the account holder’s permission to enter the mobile telephone number(s) that you provide and that you will not initiate messages to the mobile phone of any other person or entity. You agree to maintain accurate, complete, and up-to date information with Company, including, without limitation, notifying Company in writing immediately if you change, or cease being the regular user of, your mobile telephone number.
You agree to indemnify Company in full for all claims, expenses, damages, and costs, including reasonable attorneys’ fees, related to or caused in whole or in part by your failure to notify Company if you change your telephone number, or cease being the regular user of, including, but not limited to, all claims, expenses, damages, and costs related to or arising under the Telephone Consumer Protection Act, 47 U.S.C. § 227 et seq.
Changes to this SMS/Text Messaging Terms & Conditions
Company may revise, modify, or amend these SMS/Text Messaging Terms & Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to Company’s website. You agree to review these SMS/Text Messaging Terms & Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive text messages from Company will indicate your acceptance of those changes.
Disputes
Any dispute or claim arising out of or relating in any way to a Text Message Service, including the arbitrability of such disputes or claims between the parties, will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to these SMS/Text Messaging Terms & Conditions.
BY AGREEING TO ARBITRATION, YOU UNDERSTAND AND AGREE THAT YOU ARE WAIVING YOUR RIGHT TO MAINTAIN OTHER AVAILABLE RESOLUTION PROCESSES, SUCH AS A COURT ACTION OR ADMINISTRATIVE PROCEEDING, TO SETTLE ANY DISPUTES OR CLAIMS. THE RULES IN ARBITRATION ARE DIFFERENT. THERE IS NO JUDGE OR JURY. ALTHOUGH REVIEW IS LIMITED, AN ARBITRATOR CAN AWARD ON AN INDIVIDUAL BASIS THE SAME DAMAGES AND RELIEF AS WOULD BE AVAILABLE IN COURT, AND MUST ENFORCE THE SAME LIMITATIONS STATED IN THESE CONDITIONS OF USE AS A COURT WOULD.
Applicable Law
THE FEDERAL ARBITRATION ACT AND APPLICABLE FEDERAL LAW (OR IN THE ABSENCE OF APPLICABLE FEDERAL LAW, THEN THE LAWS OF THE STATE OF NEW JERSEY), WITHOUT REGARD TO PRINCIPLES OF CONFLICT OF LAWS, WILL GOVERN THESE TERMS & CONDITIONS AND APPLY TO ANY DISPUTES OR CLAIMS AGAINST COMPANY ARISING OUT OF OR RELATING IN ANY WAY TO ANY COMPANY’S TEXT MESSAGE SERVICE.
